How we collect information

ExplORer Surgical collects information that is voluntarily provided to us via our Site. The goal of our Site is to assemble and certain analyze medical and health information in order to facilitate treatment, medical research, and product improvement. ExplORer Surgical collects personally identifying information that is specifically and voluntarily provided by visitors. Such information may consist of, but is not limited to,

In addition, our system routinely collects information about the origin and site navigation of this Site’s visitors. The information is used to help us continually modify this Site based on use patterns and is not linked to any personal identifying information.

How we use personally identifying information

ExplORer Surgical may use personally identifying information about patients, including personally identifying health information. For example, we may disclose your personally identifying health information to your surgeon for purposes of treatment and research. We may also disclose anonymized information, including pictures, for publication on our mobile application(s).

ExplORer Surgical may contact you regarding products and services (such as seminars and webinars) offered by ExplORer Surgical and its trusted affiliates, business partners, and independent contractors. We may also use information we collect in accordance with uses that are communicated to the users at the time of collection. We may also use information collected through our Site for research regarding the effectiveness of our Site and related marketing, advertising and sales efforts.

Your Legal Rights

Under certain circumstances, EU residents have rights under data protection laws in relation to their Personal Information. Specifically:

Request access to your Personal Information. This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.

Request correction of your Personal Information. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request restriction of processing your Personal Information of your Personal Information. Withdraw consent at any time where we are relying on consent to process your Personal Information. Where you have provided consent to certain data processing, you have the right to withdraw that consent at any time.  A withdrawal of consent will not affect the validity of our use of your Personal Information up until the point you have withdrawn your consent.

No Fee Usually Required

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances. We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Data Transfer Commitment

ExplORer Surgical relies on the Model Contracts/Standard Contractual Clauses set forth by the European Commission regarding the collection, use, and retention of all personally identifying information that it processes and which is transferred from countries in the European Economic Area and Switzerland to the United States, both in electronic or paper form, including Personal Information and Sensitive Personal Information (defined below). ExplORer Surgical adheres to the data protection principles of: notice, choice and consent, onward transfer, security, data integrity, access, and enforcement.

“Personal information” means any information from which an individual can be directly or indirectly identified, as well as “Sensitive Personal Information” which means Personal Information revealing an individual’s racial or ethnic origin, political opinions or membership of political parties or similar movements, religious or philosophical beliefs, membership of a professional or trade organization or union, physical or mental health including any opinion thereof, sex life, and, where permitted by applicable law, criminal offences and alleged offences, criminal records or proceedings with regard to criminal or unlawful behavior. In addition for Switzerland, the definition of sensitive data includes ideological views or activities, information on social security measures or administrative or criminal proceedings and sanctions, which are treated outside pending proceedings.

In certain situations, ExplORer Surgical may be required to disclose Personal Information in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.

Changes to this Privacy Notice

ExplORer Surgical periodically evaluates its privacy policies and procedures to implement improvements and refinements from time to time. Therefore, ExplORer Surgical reserves the right to modify or amend this Privacy Notice at any time and for any reason. When this notice is amended, ExplORer Surgical will revise the “last updated” date at the bottom of this notice.
